5. Prohibited and Restricted Goods

Customers must inform TMK before booking or transporting any goods that are dangerous, hazardous, restricted, prohibited, controlled, or subject to special transportation requirements.

Depending on applicable laws, regulations, carrier policies, and destination requirements, certain goods may not be accepted for transportation.

TMK reserves the right to refuse, suspend, or cancel the transportation of any shipment that we reasonably believe violates applicable laws, regulations, carrier requirements, customs requirements, or safety standards.

6. Shipping and Transportation

Transportation services may be performed by TMK or by third-party carriers, subcontractors, freight operators, airlines, shipping lines, trucking companies, warehouses, customs providers, or other logistics partners.

Transit times provided by TMK are estimates unless expressly agreed otherwise in writing.

7. Customs and Regulatory Requirements

Where customs clearance or related services are requested, the customer is responsible for providing accurate documentation and information required by the relevant authorities.

Customs duties, taxes, government fees, inspection charges, storage charges, demurrage, detention, and other applicable costs may be charged separately unless expressly included in the agreed quotation.

TMK does not guarantee customs clearance within a specific period because clearance is subject to the decisions, procedures, requirements, and processing times of the relevant authorities.

8. Cargo Packaging and Labeling

Customers are responsible for ensuring that cargo is appropriately packed, secured, marked, and labeled for the selected method of transportation.

Where packaging services are provided by TMK, the scope and responsibility for such services will be determined by the applicable quotation or service agreement.

TMK may refuse cargo that is inadequately packaged or presents a reasonable risk to people, property, equipment, or other shipments.

9. Cargo Damage, Loss, or Delay

TMK will take reasonable measures to handle shipments in accordance with the agreed service.

However, transportation and logistics services may involve risks outside TMK’s direct control, particularly where third-party carriers, ports, airports, customs authorities, warehouses, or other service providers are involved.

Any claim relating to loss, damage, shortage, or delay must be submitted within the applicable period specified in the relevant service agreement, shipping document, carrier terms, or applicable law.

Where applicable, claims may be subject to the terms and liability limitations of the relevant carrier, shipping document, convention, or transportation agreement.

10. Insurance

Customers are responsible for determining whether cargo insurance is appropriate for their shipment.

Unless expressly agreed in writing, TMK does not represent that a shipment is fully insured against loss, damage, theft, delay, or other risks.

Customers may be required to arrange appropriate cargo insurance depending on the nature and value of the shipment.

Customers are responsible for paying all agreed service charges and any applicable additional costs.

Additional charges may arise from circumstances including:
